For allegedly refusing to obey the recent Industrial Court judgement sitting in Owerri over Suit No; NINC/OW/36/2018 in which the court gave judgement against the tenure elongation held by the state executive of the Nigeria Union of Local Government Employees (NULGE), the principal claminant, Comrade Uzoma Ekeanyanwu has insisted that Comrade Richard Eze’s led immediate state executives are risking imprisonment for alleged disobedience of the court judgement order as his group have advanced plans to obtain Court commital proceedings that would make the judgement debtors to be committed into prison.
Ekeanyanwu who is from Mbaitoli local government chapter and was the immediate past Chairman of Chairmen of the 27 council areas of the State disclosed this on Thursday at the Port – Harcourt Road, Owerri state Secretariat of the union while addressing his supporters and journalists as him and his supporters stormed the Secretariat while singing solidarity songs.
He pointed out that their mission at the Secretariat isn’t to assume leadership saying that the court judgement did not give them such mandate but rather were authorized to ensure that Comrade Victor Adebayo, as the state Secretary of the union takes interim over of the Union’s leadership activities as directed by the court and approved by the union constitution.
According to him ” There are vacancies in all the political positions of NULGE in Imo State and the 27 local government area chapters of the State except the state Secretaryship position as stated by the judgement of the Industrial Court sitting in Owerri, Suit No : NINC/OW/36/2018 instituted by me and other patriots.
The mere fact that Comrade Richard Eze’s led immediate past state executives as judgement debtors is said to have applied for an order of stay of execution of the Industrial Court judgement and have not been granted and may not be granted does not guaranteed their continued staying in the office.
They said they have equally appealed over the judgement which we are yet to receive their notice of Appeal, this again in the eyes of the law does not guaranteed them the right of continual parading of themselves as Imo State leaders of NULGE, they are simply challenging the power of the court and risking going to jail for flagrant disobedience of Court Judgement ” he warned.
Ekeanyanwu further said that, inspite of provocations, that he has asked members of the union and his supporters to remain calm and Law abiding noting that the national leadership of the union have sincerely assured them of full implementations of the court judgement which includes abolition of the leadership status quo and to conduct fresh election within one month of the judgement.
Meanwhile, the embattled NULGE State Chairman, Comrade Richard Eze in his interactions with media men insisted that, ‘ There is no vacancy in NULGE leadership structures, we have filed a motion on notice for an order of stay of execution of the Industrial Court judgement as well as appealed against the judgement in an Appeal Court of Nigeria in Owerri Judicial Division with an Appeal No; CA/OW/281/2019.
Eze also confirmed that there is calmness, peace, nolmacy and unity of purpose in the leadership structures of the union stressing that the trial judge allegedly erred in law by nullifying the tenure elongation granted to all elected officers of the union based on the doctrine of necessity and rectified through the Union’s constitution amendments during her Special Delegates Conference held in Akure, Ondo State on the 13th of June, 2016.
The union leader further pointed out that the Appeal is necessitated by his group dissatisfaction with the ruling of the trial Judge whom he alleged to have erred in law arguing that he assumed original jurdiction on the matter and went ahead to grant reliefs sort by the claimants – Uzoma Ekeanyanwu and others.
